1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of AI Construction Manager ("the App", "we", "us", or "our").
By creating an account, accessing, or using the App, you agree to these Terms and acknowledge the applicable Privacy Policy. If you do not agree to these Terms, you should not use the App.
2. Description of the Service
AI Construction Manager is a software tool intended to assist with construction project management and related activities, including planning, WBS, activity scheduling, relationships, calendars, baselines, progress tracking, Project Control, cost management, performance analysis, earned-value-related calculations, Gantt charts, historical information, reports, and PDF generation or export.
Features may be modified, added, removed, improved, or replaced as the App develops.
3. Account Registration and Security
Certain functionality requires a user account. You agree to provide accurate information when creating and maintaining your account.
The App may support authentication by email and password or Google Sign-In. You are responsible for protecting your credentials and maintaining control over access to your account and device.
4. Email Verification
Users registering with email and password may be required to verify their email address before accessing applicable features. We may restrict access until verification is completed.
5. Authorized Use
You may use the App for legitimate project-management, construction, engineering, planning, scheduling, cost-control, reporting, educational, or related professional purposes and must comply with applicable law, contracts, professional obligations, and organizational policies.
6. Your Project Data
You retain responsibility for information that you enter, create, generate, maintain, or export through the App, including project information, schedules, activities, WBS structures, costs, progress, baselines, Project Control data, descriptions, notes, images, contact information, reports, and other project-related information.
You are responsible for the accuracy, completeness, legality, and appropriateness of information you enter.
7. Third-Party Information
The App may allow you to enter information concerning project owners, contractors, consultants, project managers, clients, employees, or other persons. You represent that you have the necessary right, permission, authorization, or other lawful basis to enter and process such information.
8. Local Storage and Backups
The current version stores significant project information locally on your device. You are responsible for protecting your device and maintaining appropriate copies or backups of important project information.
Unless a feature expressly states otherwise, you should not assume that locally stored project information is automatically backed up to our servers. Device loss, damage, reset, corruption, or failure may result in data loss.
9. Professional and Engineering Disclaimer
AI Construction Manager is a project-management assistance tool. It does not replace professional engineering judgment.
Calculations, schedules, analyses, forecasts, indicators, reports, charts, recommendations, or other outputs should be independently reviewed by a qualified user before professional reliance.
The App is not a substitute for licensed engineering services, professional project-management judgment, contract administration, legal advice, financial advice, professional cost certification, safety engineering, regulatory approval, statutory inspections, professional certification, or independent technical verification. Users remain responsible for all professional decisions and project actions.
10. Scheduling and Project-Control Results
Scheduling and Project Control results depend on user inputs such as durations, relationships, calendars, working days, holidays, stop periods, actual dates, remaining durations, progress, Data Dates, baselines, costs, approved updates, and other assumptions. You are responsible for reviewing inputs and validating outputs before professional use.
11. Cost and Financial Information
Cost, budget, earned-value, performance, forecast, and related calculations are project-management tools and do not constitute accounting, investment, tax, financial, or contractual certification.
You should independently verify material financial information before using it for contractual payments, claims, financial reporting, investment decisions, or other consequential purposes.
12. Reports and PDF Documents
You are responsible for reviewing reports, PDFs, charts, tables, and other exported documents before issuing, submitting, signing, certifying, or otherwise relying upon them. Generation of a report by the App does not constitute professional approval, certification, or endorsement.
13. Construction Safety
The App does not replace site-specific safety procedures, safety professionals, applicable safety regulations, risk assessments, inspections, method statements, or emergency procedures.
Never rely solely on the App for decisions involving immediate risks to human life, structural safety, construction safety, equipment operation, or emergency response.
14. Artificial Intelligence Features
The current version covered by these Terms may not yet transmit project information to an external generative-AI provider. Future versions may introduce AI functionality.
AI-generated results, if introduced, may be incomplete, inaccurate, outdated, inappropriate, or incorrect and must be independently reviewed before consequential use.
15. Prohibited Uses
You must not use the App to violate applicable law, infringe intellectual-property or privacy rights, access another user's account without authorization, circumvent security controls, introduce malware, interfere with the App or related services, misrepresent generated information as independently certified by AI Construction Manager, process information you have no legal right to use, or engage in fraudulent or deceptive activity.
16. Third-Party Services
Certain features depend on third-party services including Firebase Authentication and Google Sign-In. Third-party services may be governed by their own terms, privacy policies, availability requirements, and technical limitations.
17. Availability, Changes and Updates
We do not guarantee uninterrupted or error-free operation. The App may be affected by maintenance, updates, bugs, device incompatibilities, Internet problems, operating-system changes, third-party service interruptions, security measures, or technical failures.
We may modify, improve, add, remove, or discontinue features when reasonably necessary to maintain, secure, or develop the App.
18. Intellectual Property
Except for user-provided content and third-party materials, the App and its software, design, branding, interfaces, original content, and associated intellectual property are owned by or licensed to the operator of AI Construction Manager and protected by applicable law.
19. User Content and Ownership
As between you and AI Construction Manager, you retain your rights in project information and content that you lawfully create or provide through the App. We do not acquire ownership of your construction projects merely because you use the App to manage them.
20. Account Deletion
Users may delete their account using the available account-deletion functionality. Deletion may require recent authentication or re-authentication for security reasons. Consequences of account and data deletion are further described in the Privacy Policy.
21. Suspension or Termination
Access may be restricted or terminated where reasonably necessary, including for material violation of these Terms, fraud or abuse, security threats, unauthorized activity, legal requirements, or conduct that threatens users, the App, or associated systems.
22. Disclaimer of Warranties
To the extent permitted by applicable law, the App is provided on an "as is" and "as available" basis.
We do not guarantee that every calculation will always be error-free, every output will meet every user's requirements, the App will operate without interruption, every device or operating-system version will remain compatible, user-entered information is correct, or generated schedules, forecasts, analyses, or reports will predict actual project outcomes.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
23. Limitation of Liability
To the maximum extent permitted by applicable law, AI Construction Manager and its operator will not be liable for indirect, incidental, special, consequential, or similar losses resulting from use of or inability to use the App, including losses relating to project delay, cost overruns, lost profits or opportunities, incorrect user inputs, loss of locally stored data, contractual disputes or claims, decisions made based solely on App outputs, or third-party service failures.
This provision does not exclude liability that cannot legally be limited or excluded.
24. User Responsibility
You remain responsible for reviewing project information, calculations, and outputs; maintaining appropriate records and backups; protecting your account and device; complying with contracts and applicable laws; obtaining required approvals; and making final engineering and project-management decisions.
25. Privacy
Use of personal information in connection with AI Construction Manager is governed by the Privacy Policy, which should be reviewed before creating an account.
26. Future Paid Services and Subscriptions
Certain functionality may in the future be offered through paid subscriptions, purchases, or premium plans. Before charging users, applicable prices, billing periods, renewal conditions, cancellation rules, and material restrictions will be presented through the relevant purchasing process.
27. Changes to These Terms
We may update these Terms when the App, applicable laws, business model, or services change. The Last Updated date will identify the most recent revision. Where required by law, appropriate notice of material changes will be provided.
28. Governing Law
These Terms will be governed by applicable law, subject to mandatory consumer-protection or other rights that apply based on the user's jurisdiction. More specific jurisdiction provisions may be added when the legal entity operating the App is formally established.
